What to do when a competitor registers a similar brand?

Our client had used its brand for 8 years without registering it. A competitor then registered a near-identical trademark. We filed oppositions with the Czech Industrial Property Office (ÚPV), with evidence of prior use and the brand's reputation. The oppositions succeeded: the competitor's mark was refused and the client finally registered its own.

Trade secret

Can a former employee use know-how at a competitor?

A key developer left for a rival, taking along technology processes the company had spent 3 years developing. The employee had no non-compete, but the information was demonstrably a trade secret. We obtained a preliminary injunction barring the use of the know-how. The parties subsequently agreed on a licence fee.
