### What to do when a competitor registers a similar brand?


Our client had used their brand for 8 years without registering it. A competitor registered a near-identical trademark. We filed oppositions with the IPO, presenting evidence of prior use and brand reputation. The opposition succeeded — the competitor's mark was refused and the client finally registered their own.


Trade secret


### Can a former employee use know-how at a competitor?


A key developer left for a rival, taking along technology processes the company had spent 3 years developing. The employee had no non-compete, but the information was demonstrably a trade secret. We obtained a preliminary injunction barring the use of the know-how. The parties subsequently agreed on a licence fee.
